Terms and Conditions

1. About Refresh Tech and Our Services
Refresh Tech ("we", "us", "our") provides digital and online services in South Africa, including but not limited to: website design and development; domain name registration and web hosting; IT support, cloud backup, cloud recovery and weekly PC maintenance plans; business software (including Basic Business Tools, Business Tools & CRM, online stores and booking systems); website builder services; social media management; digital business cards and physical NFC cards; vehicle dealership management software; property management software; holiday accommodation listings; online courses; data analysis; and marketing campaign services (collectively, the "Services").
We are a private service provider. We are not a domain registry, a social network, a payment provider or any other third-party platform. We build, configure, host and support your digital presence and business tools, and we carry out registrations and configurations with registries, providers and other platforms on your behalf and in accordance with your instructions.
2. Quotations, Engagements and Scope of Work
Project work (such as website design and development, e-commerce stores and custom platforms) is quoted upfront. The quoted fee is the fee you pay — no design or setup fees are added afterwards. Any work falling outside the agreed scope will be quoted separately and agreed with you before it begins.
Where a price is stated as "from" a certain amount, the final fee depends on the specifics of your requirements and will be confirmed with you in writing before we proceed. Timelines given are typical estimates, calculated from the moment we receive all content and information we need from you.
3. Subscriptions and Monthly Plans
Some Services are offered on a month-to-month subscription basis — including the Remote IT Support plan (per user per month), business software packages (Basic Business Tools, Business Tools & CRM, Online Store, Booking System), vehicle dealership software, website packages and social media management. Subscriptions are billed monthly in advance in South African Rand (ZAR).
- Subscriptions are month-to-month with no contract and no lock-in — you may cancel at any time before your next billing date;
- fees already paid for the current month are non-refundable, and cancellation takes effect at the end of the paid period;
- features, storage allowances and per-user pricing are as published on our website at the time of sign-up; and
- we may adjust subscription pricing from time to time, with reasonable notice to existing subscribers before the next billing date.
4. Physical NFC Card Orders
Physical NFC business cards are sold per card at the advertised price, which includes the PVC card, full-colour printing of your design on the front and back, the NFC chip, and programming the chip to your digital business card. Delivery is charged at a flat fee nationwide.
- Design confirmation first: printing will only begin after you have confirmed the final design. You always see exactly what goes to press;
- non-refundable once printing starts: because cards are personalised and programmed for you, orders cannot be refunded or cancelled after design confirmation;
- delivery estimates (typically 5–7 business days after design confirmation) are estimates — delays by couriers or printing partners are outside our control; and
- minor variations in print colour and finish compared to on-screen previews are normal and do not constitute a defect.
5. Domains, Hosting and Email
Domain names are registered in your name and remain your property. Registration and renewal fees are payable annually in advance. Domains are usually active the same day, but activation is subject to registry processing times outside our control.
Hosting includes the uptime, backup, SSL and support features published with your plan. You may transfer your domain away from us at any time, provided your account is settled; we will not hold your domain hostage. Domain renewal fees that remain unpaid may result in the domain lapsing, in which case recovery is governed by registry processes and cannot be guaranteed.
6. Your Responsibilities and Accuracy of Information
You are solely responsible for the accuracy, completeness and validity of all information, content, images and documents you provide to us — including your business details, contact details, product and pricing information, artwork and any other material we use to deliver the Services.
We shall not be held responsible or liable for any error, delay, rejection, penalty, additional fee or adverse outcome arising from incorrect, incomplete, outdated or misleading information supplied by you or on your behalf. It is your responsibility to review all details (including final designs, proofs and confirmations) before we publish, print or submit on your behalf.
You confirm that: (a) you are legally authorised to make use of the Services for the business or individual concerned; (b) you own or hold a valid licence for all content, images, logos and trademarks you supply; and (c) your use of the Services and any content you publish through them does not infringe the rights of any third party or any law.
7. Fees, Payments and Non-Refundable Conditions
All fees are quoted in South African Rand (ZAR) and are payable in advance, before work is performed, unless otherwise agreed in writing.
Fees paid for our Services are strictly non-refundable. By making payment you acknowledge and agree that:
- fees are charged for the design, development, configuration, administrative and support work performed by us, and this work begins as soon as payment is received;
- fees are not refundable in the event of a change of mind, cancellation part-way through a project, or a decision taken by a registry, provider, courier or any other third party;
- fees are not refundable where you supplied incorrect or incomplete information and rework is required; and
- third-party costs (including registry fees, payment gateway transaction fees, Meta/WhatsApp messaging charges, advertising spend and courier fees) are separate from, and in addition to, our service fees, and remain payable in full.
Where we have not yet begun any work on your matter, you may contact us to discuss your situation and we may, at our sole discretion, offer a partial refund of the service fee, less any bank or administrative costs. Nothing in this clause creates any entitlement to a refund.
8. Third-Party Platforms, Gateways and Charges
Some Services integrate with third-party platforms — such as payment gateways (e.g. PayFast, Yoco), WhatsApp/Meta messaging, couriers, AutoTrader listing feeds and Easy Systems lead notifications. Their transaction fees, per-message charges, approvals and processing times are determined by those providers and are outside our control. We do not warrant the continued availability, pricing or functionality of any third-party platform, and we will assist you in migrating to a reasonable alternative where a platform is discontinued.
9. IT Support, Response Times and Coverage
The Remote IT Support plan includes unlimited remote technical support with a committed 1-hour response time during business hours (Monday to Friday 08:00–17:00 and Saturday 08:00–13:00). Support is delivered remotely; on-site visits are optional at the advertised per-callout rate, which includes the first hour of labour, with additional time quoted upfront.
The plan covers remote diagnosis and software support. Where hardware is faulty and needs replacing, we will quote you for the hardware and the replacement work before anything is ordered or done. Response time is measured from receipt of your support request to first response, not to final resolution.
10. Backups, Data and Limitation of Liability
While our hosting and backup Services include automated daily backups and monitoring, you remain responsible for keeping your own records of business-critical data captured in the software. You should download or export important data (invoices, client records, reports) regularly.
To the maximum extent permitted by law, our total liability to you for any claim arising from the Services is limited to the fees you actually paid to us for the specific Service giving rise to the claim in the month of the claim. We shall not be liable for any indirect, incidental, special or consequential damages, including loss of income, data, business opportunity or contracts, and we shall not be held responsible for the acts, omissions or processing of registries, providers, couriers, gateways or any other third party.
11. Intellectual Property and Website Content
Upon full payment, you own your website design, domain and the content you supplied. We retain the right to display completed work in our portfolio unless you ask us in writing not to. We may reuse general techniques, code patterns and know-how developed in the course of the work.
All content on this website — including the Refresh Tech name, branding, text, design and pricing material — is owned by or licensed to us and may not be copied, reproduced or used without our prior written consent. Pricing and service descriptions are subject to change without notice; the fees applicable to you are those confirmed to you at the time of engagement.
12. Compliance and Proper Use
You agree to use the Services only for lawful purposes, and not to use them to host, distribute or promote content that is unlawful, infringing, fraudulent, harmful or offensive. We reserve the right to refuse or discontinue any Service, at our sole discretion, where we suspect fraud, misrepresentation, unlawful activity, or where providing the Services would expose us to legal or reputational risk. No refund of fees will be due in such circumstances.
13. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa, including the Electronic Communications and Transactions Act and the Consumer Protection Act where applicable. Any dispute arising from them falls under the jurisdiction of the South African courts.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. The version published on this page at the time you engage our Services applies to that engagement; for subscriptions, the version in force applies to each monthly billing cycle. Continued use of the website after changes are published constitutes acceptance of the updated Terms.
